Intellectual Property Claim Policy

If you believe that ALMAGEMS has infringed your intellectual property rights, please follow the procedure below.

A. Procedure for Reporting Intellectual Property Infringement

It is ALMAGEMS’s policy to:

  1. Block access to or remove any content (including but not limited to text, graphics, and images) that, in good faith, we believe infringes upon the intellectual property rights of others, upon receipt of a valid notice; and
  2. Remove or suspend service to repeat infringers.

If you believe that material available on or through our website constitutes copyright infringement or otherwise violates your intellectual property rights, please submit a written notice containing the following information:

  1. Identification of the copyrighted work or other intellectual property that you claim has been infringed, including registration numbers if applicable.
  2. Identification of the specific content you believe infringes on your rights, including:
    • A description of how the material is being used in a way that constitutes infringement; and
    • A detailed description of where the material is located on our website so we can locate it.
  3. Your contact details, including full name, mailing address, phone number, and email address.
  4. A statement affirming your good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information provided is accurate and that you are the rights holder or are authorized to act on their behalf.
  6. Your electronic or physical signature.

B. Action Upon Receipt of a Valid Notice

Upon receiving a bona fide infringement notice, ALMAGEMS will promptly remove or disable access to the allegedly infringing content and will notify the person who posted the material. That notice will include:

  1. Identification of the content that has been removed or disabled, including where it appeared before removal;
  2. A statement, made under penalty of perjury, affirming our good faith belief that the content was removed due to a mistake or misidentification;
  3. Our contact details (full name, mailing address, telephone number, and email address);
  4. A statement that we consent to the jurisdiction of the Federal Court for the judicial district where our address is located; and
  5. Our electronic or physical signature.

Counter-Notice and Restoration Timeline

If a valid counter-notice is received by the Designated Agent, we may send a copy of the counter-notice to the original complainant to inform them that we may reinstate the removed content within 10 business days. Unless the rights holder initiates a legal action seeking a court order to prevent restoration, the removed content may be reinstated after 10–14 business days (or later, at our discretion) following receipt of the counter-notice.

Notice of Misrepresentation under the DMCA

Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that content or activity is infringing may be liable for damages, including attorneys’ fees.
